Terms of Service
These Terms of Service ("Terms") set out the conditions for using Garoop Studio, training, work submission, comments, community features, membership plans and related services (the "Service") provided by Garoop Inc. ("we", "us"). The Japanese version of these Terms is the official version; this English version is a translation for reference.
1. Purpose
The Service provides a place where children and families can safely learn AI and digital expression, create works, and share them.
2. Users and parental consent
(1) Minors must obtain the consent of a parent or legal guardian ("Guardian") before using the Service.
(2) Paid plans must be purchased by a Guardian, or with a Guardian's consent.
(3) Guardians are expected to supervise minors' use of the Service and ensure they follow these Terms.
(4) If a minor falsely claims to have a Guardian's consent, the purchase cannot be cancelled on the grounds of minority (Article 21 of the Japanese Civil Code).
3. Accounts
Keep your login information safe and do not lend or transfer your account. Contact us promptly if you suspect unauthorized use.
4. Content you post
You may post text, images, video, audio, comments, submissions and other content ("User Content"). You are responsible for your User Content and must not infringe laws or third-party rights (copyright, portrait rights, privacy, etc.). Before posting photos or videos of other people, get their consent (or their Guardian's consent if they are minors).
5. Prohibited conduct
Harassment, bullying, threats, hate speech; sexual or excessively violent content inappropriate for children; spam, fraud, impersonation, false information; illegal acts; disclosing personal information of yourself or others; infringing third-party rights; disrupting the Service; and similar conduct that harms the safe operation of the Service or the safety of other users.
6. Intellectual property
(1) Rights in works you create remain with you or the lawful rights holder. We never require you to transfer those rights.
(2) You grant us a free license to display, reproduce, store and reformat your User Content as needed to provide, operate and improve the Service.
(3) Use of User Content outside the Service is governed by Section 9.
7. Paid plans and payment
Prices are shown on the plan page and the checkout screen (tax included).
[A] Credit card (Stripe) — auto-renewal
(1) The first payment is charged at sign-up. After that, the same amount is charged automatically every month (monthly) or every year (annual) on the same date, and the plan renews automatically.
(2) You can cancel at any time from "Manage / cancel card payment" on the plan page, the Stripe customer page (https://billing.stripe.com/p/login/6oUaEYfzk0DIaoB7S3gEg00), or by email.
(3) After cancellation no further charges are made and you can use the Service until the end of the paid period. No pro-rated refunds are given for mid-period cancellation.
(4) We will announce any price change at least 30 days before it takes effect.
[B] JPYC (stablecoin on Polygon) — no auto-renewal
(1) Pay by sending JPYC from an EVM wallet such as MetaMask to the address we specify. Each payment grants the selected period (one month or one year).
(2) There is no automatic billing. To continue, send another payment around the expiry date; otherwise access ends at expiry.
(3) A small network fee (gas, paid in POL, formerly MATIC) is required and is borne by the user.
(4) Blockchain transactions cannot be reversed. We may be unable to refund or recover funds sent to a wrong address or in a wrong amount due to user error.
(5) You are responsible for managing your wallet's private keys and seed phrase.
(6) Wallet addresses and transfer history are publicly recorded on the blockchain.
[Common]
(1) Due to the nature of digital services, cancellations and refunds after purchase are not accepted except as required by law or where we are at fault.
(2) If you cannot use the Service due to our fault, Section 13 applies.
(3) See the "Commercial Disclosure (Tokusho-ho)" page for legally required seller information.
8. Points
You may earn points by completing missions and lessons. Points are not cash and cannot be converted to cash or transferred to other users. Exchange options and conditions are shown on the exchange screen and may be changed with prior notice. Brands offered as rewards, such as Amazon gift cards, are not sponsors of the Service.
9. Publication of User Content
(1) User Content may be shown to other users according to your publication settings.
(2) Before we feature User Content outside the Service in a way that identifies a child (face, name, school, etc.), we will obtain a Guardian's consent.
(3) We will respond promptly, within reason, to requests from users or Guardians to stop publishing or delete content.
10. AI features
Some features use external AI services. What you type is sent to the AI provider to generate a response. Do not enter personal information about yourself or others. AI responses may be wrong; check important matters with a Guardian or teacher.
11. Suspension
If we reasonably determine that a user has violated these Terms or guidelines, we may remove content, restrict features or suspend the account. Except in urgent cases we will try to notify the reason in advance.
12. Changes to the Service
We may change, suspend or end all or part of the Service for maintenance, improvement, security or other reasons. If we end a paid plan, we will give reasonable advance notice and explain how unused periods will be handled.
13. Liability
(1) We are liable for damage caused to users by our intent or negligence.
(2) Where we are only slightly negligent (not intentional or grossly negligent), our liability is limited to direct and ordinary damage actually incurred, up to the total fees received from that user in the 12 months before the damage occurred.
(3) The limitation in (2) does not apply where we acted intentionally or with gross negligence.
14. Changes to these Terms
We may amend these Terms under Article 548-4 of the Japanese Civil Code. We will post the amended content and effective date on the Service a reasonable period before it takes effect.
15. Governing law and jurisdiction
These Terms are governed by Japanese law. The district court with jurisdiction over our head office has exclusive jurisdiction as the court of first instance, unless the law provides otherwise for consumer users.
